Supreme Court quash suspension order of DK SP and two others
Mangaluru: Supreme Court nullified the earlier order of high court of suspending DK SP Dr. Sharanappa, station house officer Babu Gowda and circle inspector Lingappa Poojary.

The high court on July 30, 2014 in its order has suspended the above said officers relating to a construction of a temple in Ujire.

Shashikala Shetty of Beltangady taluk had filed a criminal petition in the high court alleging that Mahesh Shetty Timarody had built a temple on a land belonging to her. In its judgement, the court had also ordered the suspension of the three police personnel.

On Sep 26, SP Sharanappa and circle police inspector filed a special leave petition in the Supreme Court, which on the same day ordered a stay on the HC judgement. After a proper hearing, on Nov 24, the SC issued its judgement, revealed the SP at media meet on Monday.

The SC has said that the HC order did not conform to CrPC 482 and was issued without giving a chance of hearing for the suspended officials. The court also appreciated the steps taken by the SP. He also informed that the first part of the HC order was being adhered to. As for the enquiry against Mahesh Shetty Timarody, the city commissioner of police would pursue the matter.
